Define a hate crime.
Any criminal offence which is perceived by the victim or any other person to be motivated by hostility or prejudice based on a person’s disability, race, religion, sexual orientation or transgender status.
Define a hate incident.
Any non-crime incident, which is perceived by the victim or any other person to be motivated by hostility or prejudice based on a person’s disability, race, religion, sexual orientation or gender identity.
What 4 offences can be hate crimes?
Harassment, Criminal Damage, Assault and Public Order
What legislation defines an offence as being racially or religiously aggravate?
Section 28 Crime and Disorder Act 1998
Define TWOC.
A person shall be guilty of an offence if without having consent if without having consent of the owner or other lawful authority he takes conveyance for his or another’s use or knowing that any conveyance has been taken without such authority drives it or allows himself to be carried in or on it.
What is a conveyance?
Anything constructed or adapted for the carriage of a person or persons by land, air or water.
Define aggravated TWOC.
Same def as TWOC but, involves an MPV and 4 aggravated circumstances.
What are the 4 aggravated circumstances for aggravated TWOC?
- The vehicle was driven dangerously
- An accident occurred by the which injury was caused to any person
- An accident occurs by which damage was cause to any property other than that vehicle
- Damage was cause to that vehicle
