hate crime:

when is it a hate crime? (hint..the law)
when the group isnt protected by the law.
underlying crimes:
hate crimes often overlap with preexisting crimes (NO HATE OR BIAS)
EX. gang violence, terrorism, political violence, war)
retribution:
this type of offender deserves to be………?
hate crimes are different from ordinary crimes.
offender deserves to be punished more than ordinary offenders.
arguments supporting need for hate crime; 4 factors:
- victims may suffer more psychological trauma
- victims may suffer more physical trauma
- hate crime may have a wider impact
- hate crime may spark retaliation and conflict
bias intimidation:
raising voice, violating personal space, when you feel you’re in iminant intimidation danger
-police don’t need proof for this
institutional vandalism:
destroying protected property.
-not only destroying property but hurting the people who are connected to it.
EX. church, temple, sinegog, etc.
you can burn ____ ___ (1st amen. freedom), but burning the cross is a ___ ___.
your flag, but burning the cross is a hate crime.
3 parts to hate crime:
- retribution (we need hate crime)
- deterrence (for there to be control and to fix things)
- symbolic effects (denouncing hate crime)
