Recommendation from the Royal Commission of Inquiry into the March 15 2019 Christchurch attack which directs police to train staff around hates motivated events
What is the Police working definition of a hate crime?
” Any offence which is perceived, by the Victim or any other person, to be motivated, wholly or in part, by a hostility or prejudice based on a person’s particular characteristic, such as race, religion, sexual orientation, gender, disability or age.”
What is not criminal Hate speech
When it falls short of a criminal threshold. This is considered “awful but lawful” and should still be recorded as a hate incident

Section 131 of Humans Rights Act 1993
Evey person commits an offence when inciting racial disharmony
Section 132 of Human Rights Act 1993
No prosecution for an offence against 131 of this Act shall be instituted without the consent of the Attorney-General
