What is a Hate Crime? (Two Elements)
Hate crime is behaviour that aims to cause a person, family, community or group etc … to suffer fear or distress AND they were singled out on account of their vulnrability
What is a Hate Incident?
Not necessarily a crime, though both are motivated by prejudice/hate
What are the characteristics/presumed characteristics that constitute a hate crime/incident?
- race
- religion
- sexual orientation
- transgender identity
- disability
What is a vulnerable adult/adult at risk?
Adults over 18 that need care and service and MAY be unable to defend themselves from serious harm and exploitation
Which sections of the criminal justices act provides additional sentencing powers aggravated by hate crime characteristics?
Sections 145 + 146
What is the definition of ‘Disability’?
Physical and/or mental impairment that has a substantial and long term effect on the persons day-to-day activities
