A person handles stolen goods if otherwise than in the course of stealing, knowing or believing the goods to be stolen, he dishonestly receives the goods or dishonestly undertakes or assists in relation to their
Retention, removal, realisation or disposal
By or for the benefit of another or if he arranges to do so.
What counts as stolen goods
Anything obtained by some form of theft or stealing abroad, anything that was exchanged for the stolen goods (money or other property). It excludes land but not items severed from the land.
When do stolen goods cease to be stolen goods
The goods stop being stolen if they are in lawful possession, returned to the owner, owner abandons them or ceases to claim.
What are the points to prove for handling stolen goods
- The goods were stolen or dishonestly obtained
- They were still stolen at the time of handling
- The accused receives the goods or dishonestly undertook or assisted in there RRRD
- Knew or believed the goods to be stolen at the time of handling
