Administration of safety and
health laws
a. The DOLE is responsible for enforcing occupational safety and health laws in workplaces. Chartered cities can conduct safety inspections if they have the required facilities and qualified personnel, following DOLE standards.
b. The Secretary of DOLE can set fees for inspections and approvals of equipment and safety devices. These fees are deposited in a national fund used solely for safety and labor law enforcement.

a. The Secretary of Labor or authorized representatives can inspect workplaces anytime work is happening. They can review records, question employees, and investigate to ensure compliance with labor laws and regulations.
b. The Secretary of Labor or authorized representatives can issue orders to enforce labor standards based on inspection findings. They can also enforce these orders unless the employer challenges the findings with new documentary evidence not reviewed during the inspection.
c. The Secretary of Labor can stop work or suspend operations if violations of laws or rules pose serious danger to workers’ health and safety. A hearing will be held within 24 hours to decide whether to lift the order. If the employer is at fault, they must pay workers their wages during the suspension.
d. It is illegal to obstruct or delay the Secretary’s orders. No court or entity can block these enforcement actions with injunctions or restraining orders.
e. Government employees who violate or abuse their authority under this Article will face dismissal after an investigation.
f. The Secretary of Labor can require employers to maintain employment records to support inspections and enforcement actions.
