District Courts?
Is the state level courts and the lowest court that deals with more minor issues.
Grand jury?
determine if there is enough evidence to take the case forward with the court.
Petit jury?
they decide if the defendant committed the crime.
Circuit/appeals courts?
they decide if the case is enough to take up with the
Judicial review?
the supreme court decides if a law is under review or to declare a legislative action unconstitutional
Marbury v. Madison?
the court case that helped give power to the supreme court.
Rule of Four
if four justices want to hear a case it is added to their docket (case load)
Precedent
they will love at other cases to see what other judges have said and look at the rationality, legality and constitutionality of the arguments made. The idea of looking at previous cases of the supreme court and other lower courts
swing vote
A swing vote is a vote that could potentially favor either side for a decision.
Opinion
both sides will then write the reason of their vote in documents called this
Dissenting opinion
minority opinion, disagrees with ruling
concurring opinion
agrees with ruling reached by majority but for different reasons
Establishment clause
prevents creation of national religion “speration of church and state” cannot require school prayer
Free exercise clause
freedom to believe what you want
Defamation
damaging someones reputation
