Ceremonial Marriage: General Requirements
(1) License
(2) Solemnization
Ceremonial Marriage: Age
(1) 18 or older = no restrictions
(2) 17 = parental consent or judicial approval
(3) 15/16 = petition of court
Ceremonial Marriage: Timing
Parties should get married within 60 DAYS after license issued or else it will expire
Ceremonial Marriage: Solemnization
Ceremony can be performed by judge, political official, or member of the clergy
Common Law Marriage: General Requirements
(1) Parties agree to be married;
(2) Cohabitation; and
(3) Hold themselves out to public as married
Common Law Marriage: Indiana
CANNOT be legally created in Indiana
Indiana will recognize common law marriages validly created in a state that allows them
Capacity to Get Married
Parties must be:
(1) Old enough;
(2) Not too closely related; and
(3) Able to understand the nature of the act
Intent to Get Married
Must be evidenced by words in the PRESENT TENSE
Gifts In Contemplation of Marriage
(1) Gifts conditioned upon marriage need to be returned if marriage does not occur
(2) Engagement ring must be returned
