Both parent’s must consent
Unwed fathers have the right to consent, but may waive that right
Voluntary Termination: Withdrawal of Consent
May be withdrawn with court approval WITHIN 30 DAYS after signed
Involuntary Termination
Parents have a constitutional right to raise their own children but their rights can be terminated by the court in an ABUSE, NEGLECT, OR DEPENDENCY case
Involuntary Termination: Petition for Termination
Must be filed by the state or a child’s guardian
Involuntary Termination: Best Interest of Child
Termination must be in the best interest of the child, and there must be a plan for the CARE and TREATMENT of the child
