IEEPA… if it says anything with “Violation of executive order” it will be IEEPA.
What are the elements for Maritime Drug Law Enforcement Act (MDLEA)?
- Knowingly or Intentionally
- Manufacture or distribute, or possess with intent to manufacture or distribute
- A controlled substance
- Any person on board a U.S. vessel or vessel subject to U.S. jurisdiction OR U.S. citizen or U.S. resident alien on board any vessel.
If a foreign plane transfers drugs to a foreign boat in high seas, would that be a violation of 19 U.S.C. 1590 (b) Aviation smuggling -Sea transfers?
If both are foreign owned and registered, but we can prove that the vessel intended to unlawfully introduce the merchandise into the U.S then it is a violation.
What is 19 U.S.C. 1590 (b) Aviation Smuggling- Sea Transfers?
-Transfer merchandise between aircraft and vessel
-On high seas or customs waters
-If not authorized and either of the following exist:
-Either the vessel or aircraft is U.S. owned or
registered
- Both vessel and aircraft are foreign owned and
registered, but we can prove that the vessel
intended to unlawfully introduce the merchandise
into the U.S
If a U.S aircraft in high waters transports drugs to a U.S. vessel would that be a violation of 19 U.S.C 1590 (b)?
Yes. Just the mere transport is a violation.
