What are controlled deliveries used for?
- Locate, ID, Arrest, Convict Violators
- Disrupt, dismantle criminal organizations
- Broaden scope of investigation
- ID/Prosecuting higher-level violators
- Obtaining additional evidence
- Est evidence of guilty knowledge
- Id violator’s assets for forfeiture
What is a Cooperating Defendant?
Someone working for U.S that is working off charges.
- Agrees to deliver contraband to intended recipient
- Defendant must be: 18 or older, Under control of LEOs, arrested, searched, debriefed
- AUSA advised
- Waiver of Miranda right obtained
What is a Non-cooperating Violator?
Contraband discovered but allowed to proceed under surveillance.
Violator unaware contraband discovered
Transporter may not know of concealed
contraband
Attempt to ID destination, travel route, intended recipients
SAC must approve cold convoy
Need AUSA concurrence
What is a Pass Through?
Contraband imported/exported at gov direction
Op must have concurrence of CBP Port Director
Requesting agency makes formal request to SAC
Uses CIs or UC agents
On entry to U.S HSI places security controls on contraband (tracker, kill switch, or transmitter)
Obtain FDIN from EPIC for controlled substances.
When planning an operation should you obtain concurrence from transit and destination SAC offices that your controlled load might pass through?
Yes.
Should you take photos/video of the evidence to memorialize the controlled goods?
Yes
When you substitute with sham drugs what about amount of real controlled substances should you leave in the controlled load?
