Definition and act
Under s18 and s20 of the OAPA 1861 as unlawfully maliciously wounding or inflicting GBH on another person
S20= some harm/recklessness
S18= serious harm or intent to resist lawful apprehension
What is GBH?
Really serious harm (DPP v Smith)
What is assessing harm?
Assessing the characteristics of the victim (Bollom)
Types of harm under the CPS charging standards
Broken bones or biological harm such as HIV (dica)
What is wounding?
Both the dermis and epidermis of the skin have been broken and internal bleeding will not count as wounding (Eisenhower)
What is the MR?
S20= intent to cause some harm or recklessness to cause serious harm (partmenter)
S18= intent to cause serious harm (Taylor)
