הכלי שנאבד היה בשימוש הבעלים במשך זמן קצר שהוא לא היה יכול להכיר בו את הכלי

אם לא שבעתו העין - אינן חייב להכריז כלל אם מצא כלי ששבעת העין- חייב להכריז כמקום שמצויים ת”ח - (תוס.) ואם המאבד התובען הוא תלמיד חכם יש להשיב לו ואם הוא עם הארץ לא ישיב לו

if the eye is not satisfied you don’t have to return at all but if you found a tool that the eye is satisfied then you have to return it and if the loser is a wise student it must be returned even if the eye is not satisfied because you know he won’t lie.

מר זוטרא היה לומד עם תלמידיו בבית של המארח , ולפתע נגנב כוס גביע מכסף למארח הבחין מר זוטרא תלמיד אחד שנטל ידיו וניגב בגלימא של חבירו ללא רשות מיד הבין שהוא הגנב ובאמת הלקו אותו עד שהודה לבסוף
