Wise brothers got sued by shareholders after merging with Peoples company failed → Shareholders cannot sue for breach of fiduciary duty, can sue for negligence
Kanitz v. Rogers
Mandatory arbitration clause forced to consumers through e-commerce -> class action lawsuit claimed there wasn’t sufficient notice
