What is the purpose of FERPA?
To protect the privacy of student’s educational records.
Who does FERPA apply to?
All educational agencies or institutions that receive funds under any program administered under the Secretary of Education.
What is directory/public information?
Info contained in an education record that would not generally be considered harmful or an invasion of privacy if disclosed
What can directory info never include?
SSN Student id # Race Ethnicity Nationality Gender
Can directory info be released to anyone if requested?
Not if the student requested directory info be withheld. Yes if the student did not request for directory info be held
What are education records?
Any record of an institution that contains info directly related to the student and is maintained by the school or its agent or a party acting in its behalf.
Education records do not include…
Records/noted kept in sole possession of maker
Medical records
Employment records when employment is not contingent on being a student
Records created and maintained by campus police
Alumni records
How can a student request that their info be withheld?
Request on or before the census date of each session or semester by completing a Request to Prevent Disclosure of Directory Information form to prevent release of directory info.
How long does the withhold directory flag remain in effect?
Until the student requests in writing that it be removed
