Which law standards are more strict with controled substances?
State law is stricter and can not conflict with Federal Law
Which set of law does the pharmacist have to follow?
The more stricter set of laws.
What is a schedule 5 drug?
any drug that has the potential to cause dependence but the risk is extremly low
What is a schedule 1 drug?
drugs with no medical use
heroin, LSD, Peyote, Marijuana ect
What is a schedule 2 drug?
drugs with a high potential for abuse but have an accepted medical use. Severe physical or psychological dependence.
What is a schedule 3 drug?
a drug with moderate potential abuse/dependence
What is a schedule 4 drug?
a drug with mild/low potential abuse/dependence
What changes can a Pharm.D make to a Schedule 2 prescription?
dosage form, drug strength, drug quantity, direction and issue date.
What changes can a Pharm.D NOT make to a schedule 2 drug.
Patients name, Drug name, and Physican’s name
How many refills can be applied to a non-control, C3-C5, and C2 medication.
Non-controls- 1 years worth
C3-C5- 6 months (5 additional refills)
C2- no refills period
What is the maximum day supply that can be dispensed for a CII?
90 days
Multiple C2 can be prescribed as long as:
each is for a legitamate medical purpose notes the earliest fill date Can not be post dated legal under state law have separate rx numbers can not change the written date

what Schedule label and packaging details are required?
must have the control symbol on it and prominently located
What activites require registration for contorled substances?
manufacturing, distributing, dispensing, prescribing, research, chemical anaylsis, importing and exporting controled substances
What are the pharmacy registration requirements for dispensing controlled substances?
register with the DEA
each pharmacy registered separately
Renewal every 3 years
What is the formula for DEA number?
add together odd digits
add together even numbers and multiply by two
add the two numbers together from odd and even digits
the last digit of that number should match the last digit of the DEA #
What is the definition of delivery under the Controled Substance Act?
the delivery of a controlled substance
Do researchers have to register?
yes but not separate if they have registered to dispense

if application is falsified, convicted of a felony, state license suspended or denied
What is required of you in terms of sercurity?
gaurd against theft, diversion, lock controls in a cabinet, , can not employ anyone with a suspended or revoked license
What penalties can occur?
if prescribe/dispense outside scope of practice, negligance for record keeping, 222 form discrepancies $30,000 and 4 years in prison, posession without a prescription
What is the scope of the DEA in inspections?
any place where CS records are kept, or where someone is registered.
allowed to inspect records, inventory of CS and not pricing or sales
compare inventory to records
must present intent and verify idenitity first
What is a Notice of Inspection (NOI)
must have name of owner, business name and address, date and time of inspection, and statemetn NOI was given

requires probable cause, in the interest of the public for large purchases of CS, compliance, record keeping,
created by supreme court as an alternative for search warrant, can only be served durring buisness hours

yes, some states without a warrant
what are the requirements for opioid treatment?
must have legitamate medical purpose, there should be dependance as a side effect,
What is the Opioid Treatment Program?
allow detox for addicts, must be dispensed at a OTP facility, methadone, buprenorphine nalaxone and LAAMM are authorized for treatment of addiction
What is detoxification opioid treatment?
the decrease in dose to prevent withdrawl
What is maintanence opioid treatment?
dispensing opioid for duration longer than 21 days
Is methadone a legal treatment as an antitussives?
No
What strength of methadone is specifically for OTP?
40mg volunteered by manufacters
What is Drug Addiciton Treatment Act (DATA)
allows for addicts to get treatment in an office setting, only with subutex and suboxone
must be treated by a qualified physician with no more than 100 patients
must have special DEA
What is the combat methamphetamine act?
restriction of quanity of products OTC that are used to make meth, psuedoephedrine and ephedrine
limit is 3.6 grams per reson per day
sold behind counter in blister packs
requires state ID and log of transaction
signature of patient, bar code on ID can be used
Is it illegal to posess methamphetamine precursors?
IN colorado (state law) only if there is an intent to manufacture
what is the controlled substances registrant protection act?
federal crime for stealing more than $500 of CS or for anyone involved in the crime
if a weapon is used fine increases to $25,000 and penalties greater
if death results, penalties are even greater
