Grounds for a protection order
Was family violence, is necessary for the protection of the applicant
Powers to arrest for breaches of a protection order
Section 50, domestic violence act 1995
3 standard conditions
No contact
No weapons
No violence
PO & PSO
PO - applicant and respondent
PSO - person at risk and bound person
Occupation order
Gives exclusive right to occupy dwelling house- doesn’t apply to rental properties
Tenancy order
Gives the applicant the tenancy of any dwelling house
Ancillary furniture order (must have occupation or tenancy order)
Gives exclusive possession and use of furniture, appliances etc
Furniture order
Same as ancillary but no other order required
Power of arrest section 50
Contravened the protection order or failed to comply with any condition of the protection order
