Passed by the Howard government to make sure the definition of marriage did not include same sex couples. Now incorporated in Marriage Act 1961 (Cth) and Family Law Act 1975 (Cth)

A
Valid marriage must be:
- a union of a man and a woman (ft. Corbett v Corbett 1970)
- voluntarily entered into
- for life (intention)
- to the exclusion of all others
