Sec. 12-84(A) Exemption to 12-83
Religious organization: insisting employees adhere(believe/follow practice) to the tenets of the religious org. as condition of employment.
Sec. 12-84(B) Exemption to 12-83
Nothing requires an employer to hire or retain individuals or employees if there is a legitimate non-discriminatory, non-retaliatory reason to terminate
Sec. 12-84(C) Exemption to 12-83
Does not prohibit employer from requiring an employee during work to adhere to reasonable dress or grooming standards
Sec. 12-84(D) Exemption to 12-83
Employer that observes a bona fide seniority system or affirmative action plan that is not to evade this article.
Define Affirmative action plan
Plan devised to effectuate remedial or corrective action taken in response to past discriminatory practices against a marginalized group, or otherwise required by federal or state law.
Sec. 22-158(a)(5)
(a) no for-hire company, for-hire vehicle owner/driver shall:
(5) Refuse or neglect to transport any person on the basis of a protected class defined in chapter 12.
Who is not included in the definition of disability
Person currently engaging in or convicted of manufacturing/distributing illegal substances, transvestite, people who may pose a direct threat, juvenile and sex offenders
How is alcoholism treated in the Fair Housing act and the ADA
Alcoholism is a covered disability, unless an individual cannot participate in federally funded housing programs, or they pose a direct threat to the property and others.
