Why is Labeling important? How can it be detrimental?
Students cannot receive sped services until they are labeled with a specific exceptionality. However, having a “label” could cause stigma and discrimination.
What is “People First” language
The language we use when referring to people with special needs. We always refer to the person first (ex. A person who uses a wheelchair, a man with a disability)
2 main types of discrimination
Exclusion: Children with disabilities not allowed in schools; they could be sent away (this is illegal now)
Misclassification: Commonly happens among students who are culturally diverse
IDEA
Individuals with Disabilities Education Act; made FAPE a thing in 1975; opened schools to all students with disabilities
Rule against excluding any student (part of 6 principals of IDEA)
Zero Reject
Requires schools to evaluate students fairly to determine a disability (part of 6 principals of IDEA)
Nondiscriminatory Evaluation
Requires schools to individually tailor education based on student evaluations (part of 6 principals of IDEA)
Appropriate Education
Requires schools to educate students alongside peers without disabilities (part of 6 principals of IDEA)
Least Restrictive Environment
Right to sue schools in court (part of 6 principals of IDEA)
Procedural Due Process
Rule requiring schools to collaborate with parents and adolescent students in carrying out programs (part of 6 principals of IDEA)
Parental and Student Participation
8 parts of Least Restrictive Environment (from top to bottom)
- General Education Classes
- Pull out (students are mostly in gen-ed classes, but may get pulled out for some help)
- Self-Contained (students only spend time in a sped class)
4 Public Day School (students bussed in from wherever) - Private Day School (^^ but cost $$$)
- Residential School (24 hour/day care)
- Homebound (fragile, ill)
- Hospital/Prison (a district will send a teacher into prisons or home to help educate)
