Point 1 : Entrenched

A
  • UK constitution not entrenched, so devolution act of parliament, whereas US constitution is entrenched so federalism part of constitution
  • Means that devolution could be overturned or expanded e.g. further devolution in Scotland 2016
  • Federalism would be very difficult to remove as it is entrenched

  • Devolved bodies have a fusion of powers, federalism has a separation of powers
  • Devolved bodies draw their executives from legislative bodies, federalism elects executives

A
  • In federalism power shared equally between state, In devolution power not shared equally
  • Individual states in the US have equal power to make legislation
  • Devolution, it depends where you live
  • E.g. Scottish Parliament originally given limited tax powers, whereas Welsh assembly was not
