What is the Reply Letter Doctrine?

A
  • doctrine that allows a letter to be authenticated by content and circumstances indicating it was in reply to a duly authenticated one.
  • proponent of evidence must prove first letter was
    • dated
    • duly mailed at a given time and place, and
    • addressed to sender of reply-letter

Is a prior statement by a witness, if that witness is testifying and available for cross-examination, hearsay?

A

It is not hearsay and is admissible if it is one of identification of a person made after perceiving the person (one of prior identification)
