What are the obligations of firms once they are registered for regulation?

A
  • Comply with the rules of conduct.
  • Act in accordance with RICS Royal Charter and Byelaws.
  • Inform Head if Regulation of any findings against it by any disciplinary or regulatory body, court or statutory authority.
  • Inform the Head of Regulation of any findings of insolvency against the firm.
  • Notify the Head of Regulation within seven days if there is a material change regarding the firm and provide details.

What is a locum?

A
  • A firm which has a sole principal must have in place arrangements in the event of that sole principals incapacity to work.
  • A locum is effectively another professional who is appointed to ‘stand in’ for the incapacitated sole principal.

Who can be a locum?

A
  • Typically another chartered surveyor but can also be a solicitor or accountant by trade.

How does PI insurance cover relate to locums?

A
  • Locums need to be covered for any work undertaken whilst a sole practitioner is unavailable.
  • This could be under their own cover, or under the forms PI policy
