o Case involving land fraud in Georgia supreme court. establishes that State cannot pass law invalidating a contract.
o 1st time that supreme court declares state law unconstitutional.
o Marshal proclaims that contract between private individuals is sacrosanct (Into the 20th century, this precedent is used to uphold morally questionable contracts, like child labor)

o Ogden is ferry owner-Makes contract with NY state which gives him monopoly
o Gibbins wants to start a new ferry, and sues NY for giving ogden monopoly
o Marshall sides with gibbins because its interstate commerce and only the fed. Can regulate this.
-The federal gov’s stretching of the Interstate commerce clause sets precedent for future (like making southern hotels and gas stations serve blacks)

  • The Tarrif of 1816 was an increase in tariffs led by clay
  • It protected American industry so northerners liked it but farmers (=southerners/westerners) hated it because they felt it did not benefit them and just made products more expensive

  • Clay rechartered the Hamilton’s 1st national bank (whose charter had run out) with a permanent charter
  • National Bank- had become controversial since the West and South felt it symbolized evil eastern city rich people selfishly manipulating economy, so a permanent charter was necessary to ensure its continuation

Andrew Jackson-Florida

  • Violent Seminole Indians, pirates and slaves would escape to Florida and make trouble for the US
  • President Monroe sent General Andrew Jackson to protect the border with Florida
    -Jackson used this as an excuse to invade Florida
    -Known as the Seminole War, but in fact Jackson attacked the spanish and British Pirates
    -Spanish decide to sell florida to US as part of the Adams-Onis treaty
    (Adams is John Quincy Adams (Secretary of State))

  • Heated Debate
  • Compromise: Missouri would come in as a slave state, but Massachusetts would be divided, creating a new free state called Maine also, any future new state North of the Southern border would be free and South of the Southern border (Mason-Dixon Line) would be slave
  • This makes slave debate erupt
