What is an AMO agent’s Immigration Enforcement Authority & Function?

Answer 1

Authority = INA 287(a)(1) interrogate any alien or person believed to be an alien as to his right to be or to remain in the United States

Function = during a consensual encounter or suspicionless seizure (ie. Border detention, vessel document check, or a pilot certificate inspection) anywhere (no mileage restriction) determine immigration status of individual. If RS of illegal presence then investigative detention

What are Border Patrol Operations?

Linewatch = within 25 miles of border
Roving patrol = anywhere BP has an operational presence
Immigration Checkpoints = Similar to DUI checkpoints located from 25nm to a “reasonable distance” of 100 air miles from actual border
City Patrol and Transportation Checks = anywhere BP has an operational presence

Explain Immigration Checkpoint Operations

Answer 3

Zero suspicion stop at primary to determine immigration status
If no suspicion then terminate encounter and admit to US
If some/mere suspicion of immigration violation then send to secondary
At secondary, if no suspicion of immigration violation developed then terminate encounter
At secondary if PC developed then arrest
If RS of illegal activity then send to secondary
At secondary, if no suspicion developed then terminate encounter
At secondary, if PC developed then arrest
If PC of illegal activity then arrest
