Programs in the Economic Class
Express entry or Direct application?

Express Entry: the applicant must apply online for express entry, then invited and then apply for PR status and then submit to one of the following programs. FN must go through the process and then meet the requirement of the underlying immigration category
- CEC
- FSWP
- FSTP
- PNP (on approved programs and selected provinces only)
Direct Application : when they have met all the requiremenst and can apply to one of the programs for direct PR status
- PNP
- Quebec Economic Class
- Self Employed
- Start Up
- Atlantic
- Rural and Northern Immigration
- Home child care and home support worker pilot
Dependent Child
The applicant may include the dependent child in their PR application
- lock in date for the dependent child is once the the IRCC receieves the completed application for PR from the principle residence
- even with the locked in age, if the dependent gets married or is in a common law relationship then the officer may deem that the dependent is no longer a dependent
- all dependents must be examined regardless if they are accompanying the FN to Canada or not
- if the dependent is rendered to be inadmissible, accompanying or not, the FN will also be considered as inadmissble and application for PR will be refused.
- applicant may change/add dependent child that will be accompanying them to the application, as long as they were still a dependent on the lock in date
Medical Exam
- all applicants are required to complete a medical exam, generally completed after the appication is submitted to ensure that it does not expire during the processing period of the file
- all applicants, accompanying or not will have to pass the medical exam or the application will be refused
Express Entry
An electronic application management system-
- FSWP - selection is based on the applicant’s ability to settle in Canada and contribute to the economy
- FSTP - selection is based on the applicant’s qualification in a skilled trade
- CEC - pathway for TR with authorization to work to transition permanent resident
- PNP - only certain PNPs are permitted to use the EE process to select applicants to fill their regional labour shortage
- for a FN to be assessed under any of these streams they must first pass through the EE process
- EE allows employers, provinces to recruit and select skilled immigrants from a pool of candidates
Process
- once they have applied online, and have been assigned a CRS score, the application sits in a virtual pool waiting for an invitation to apply for one of the processing streams
- if the FN recieves an ITA, they will be able to apply to one of the EE economic immigration programs
- the ITA will advise the applicant as to which economic stream his application will be assessed against and must meet the requirements of the processing stream
Arranged Employmenta
Additional point (CRS system) are awarded if there is a job offer from an employer
Qualified job offers are:
- a FN that has an LMIA from ESDC and the employer has provided the FN with a written job offer
- a FN that is in Canada on an LMIA-exempt work permit and have worked here for at least one year and the employer has made a formal job offer for at least one year.
FSTP: up to two employers can make a written job offer, but the FN must be working for the two employers
Federak Skilled Worker Program (FSWP)
Requirements : r. 76
- Proof of language proficiency CLB 7 in all skills
- Secondary school or post secondary degree
- 1 year of continuous full time of paid experience in the same NOC - 0,A or B (calculated as 1560 hours total or 30/week)
- FN must demonstrate that they have duties of the lead statement and majority of the main duties
- proof of funds (50% of LICO)
- NOTE: proof of funds is not required if there is a guaranteed job offer
- arranged employment, should be an occupation that is appropriate to the NOC level
- proof of job offer is obtained from ESDC in the form of a LMIA
Federal Skilled Trades Program : Requirements
r. 87.2 (1)
- not accessed on a points systen like FSWP
- NOC skill level B occupations can submit application for PR status and meet the following minimum requirements
1. Language: CLB 5 for speaking and listening and 4 for writing and reading
2. Experience: in the last 5 years, accumulated 2 years of full time experience in the skilled trade and must have performed the lead statement and substantial number of the main duties listed
3. Job Requirements: meet all the requirements for the job (other than the provincial qualification certificate)
4. Offer: have a confirmed job offer for at least 1 year
5. Intention to live outside of Quebec
NOTE: there is no education requirement for FSTP
Canadian Experience Class
CEC
FN must have worked in Canada for a period of at least one year, within the last three years, with a valid work authorization may qualify for PR status under the CEC - can either be part time or full time, but must equate to one year
- work must be in either NOC 0, A or B
- must have perfoemd the actions in the lead statement and majority of the main duties listed
- meets the language threshold
Implied Status: work accumulated under Implied status can still be counted towards the one year requirement, as long as the work condition remains the same as under the original work permit
Experience not counted (r. 87.1 (3)(c))
- employement if the FN was in school
- any period of self-employment
If the officer is unable to make a decision with the provided information
Start Up Visa Program
Objective is to link immigrant entrepeneurs with Angel investor groups, r 98.06,
- a new bsuiness that is intended to be operated in Canada and has recieved support from one of the Designated business organizations
- if the Designated business approves of the business plan then will send a letter of support to IRCC with the certificate of commitment
the following conditions must be met:
- the applicant holds 10% or more of the voting rights, up to five people can apply as owners and each applicants holds a minimum of 1- %
- applicants and the designated organization will jointly hold 50% or more of the voting rights
Once PR has been approved
- the applicant must provide active and ongoing management of the business within Canada
- an essential part of the business operations must be conducted in Canada
- the business must be incorporated in Canaada.
Eligibility
- sufficient settlement funds
- support and certificate of commitment
- language proficencies
- intend to reside in a province other than QC
- have a qualifying business
- be admissible
Investor-Incubator Program
If accepted, no investment from the incubator is required, otherwise, applicant must secure one of the following
- a min investment of 200k if the investor comes from one or more of the designed Canada venture capital funds
- min investment of 75 k if it comes from two or more designated Canada angel investor group
Self-Employed Program
Applicants must generally have relevant experience and the intention and ability to be self employed
Requirements:
Work experience: min of 2 years of experience in the last 5 years before the date of application for PR
Role of experience: self employed in an eligible occupation or in a world class level
Intention and Ability
- must be able to contribute significantly, however, significantally is difficult to define.
