What are the steps for breath and blood alcohol testing

A

Passive breath testing.
Breath screening test (BST)
Requiring the person to accompany me.
Conduct a Evidential Breath Test (EBT).
If failed BST, require to accompany me to station.
If they refuse they can do a blood test or 10 mins after they fail they can do a blood test.
If they refuse they are charged with refusing officers request for blood.
Then the doctor or nurse can take blood and if they refuse they can be charged with refusing Dr’s request for blood.

A

Under 20 breath 150, blood 30

Over 20 breath 400, blood 80

If the driver requests blood do you have to give the 10 min rule?

A

No only if they have failed the EBT

When would you suspend someone’s license for 28 days under section 95 of the LTA for an EBA

A

Been found to have breath alcohol over 659 mcg of alcohol per litre of breath.
And failed or refused a blood test at the request of an enforcement officer or authorised medical person

When would you impound someone’s car for 28 days under section 96 of the land and transport act for an EBA

A

Been found to have breath alcohol over 400mcg or alcohol per litre of breath and had two previous convictions for any ‘relevant offence’ within the last 4 years
