Identify the FIVE situation when a constable can request a breath-screening test
- Any driver of a motor vehicle on any road (RANDOM STOPPING)
- Any person attempting to drive a motor vehicle on any road.
- Any person you have good cause to suspect, has recently committed an offence, against the road provisions of the Land Transport Act that involves driving of a motor vehicle.
- A driver of a motor vehicle, involved in a motor accident
- Where the driver is not known, you have good cause to suspect, passengers in a vehicle, involved in a motor accident
Identify the age requirements for EBA charges

Identify when a driver has failed a BST (by age/licence)
Over 20Years old.
- Over 400
- 250+ over
Under 20 years old.
- “UNDER 250”

State the four requirements you can make during the EBA procedure

Identify the breath and blood alcohol levels which are infringement offences
20 years and older
- Between 250-400 Breath alcohol
- Between 50-80 Breath alcohol
Under 20 years old
- Up to 150 breath alcohol
- up to 30 blood alcohol
Identify the offences for which a person can be arrested during the procedure
over 20 years old
- 400 breath or over
- 80 blood or over
Under 20 years old
- 150 breath or over
- 30 blood or over
Note: Only arrested if:
- it is necessary to complete EBA
- If you BELIVE they will endanger public by driving again.
- Doubt about their identity
- Doubt about locating them for serving a summons
- To ensure that they will appear in court.
Responsibilities during the 10-minute period in relation to a right to request blood
You must give AT LEAST 10 minutes (give 12) for them to decide whether to have a blood sample taken.
- do NOT advise the driver on what to do.
When is a summons used in relation to EBA
When a person accepts the EBA result and is not already arrested.
Should not summons a young person under the age of 17 (16 or younger). The file should be prepared and given to Youth Aid Section and FGC
