Section 8
This section is about the responsibilities to parents when dealing with child or young person
if a police officer takes any action or makes any decision that SIGNIFICANTLY affects a child or young person they should inform a parent/guardian
Section 214
Police powers of arrest without warrant of children or young person.
No arrest unless WEEP
W - Witness (Prevent interference with witness)
E - Ensure appearance in court
E - Evidence (Prevent loss/destruction)
P - Prevent further offences
Must report arrest within THREE DAYS
Section 214A
Arrest of child or young person in breach of bail conditions
3rd Strike and can arrest
A constable may arrest a child or young person if…
a) a child is released on bail
and
b) a constable believes that
- a CYP has breached a condition of that bail
AND
- A CYP has breached bail 2 previous times
Section 222
Nominated person
Needs to be:
Adult (over 20 years)
Can’t be cop unless parent
Cops can exclude when: Pervert the course of justice co-offender can't be located Not available within reasonable time
