Question 1: You are an investigator on duty when you receive information about the
existence of a Drug Premises in your LAC. What is the definition of a Drug Premises and
under what circumstances would you apply for a warrant utilising this legislation?
Definition:
- Any premises that are used for either or both of the following
- The unlawful supply or manufacture of a prohibited drug
- Unlawful cultivation of prohibited plants by enhanced indoor means
Issue of a search warrant:
- An OIC of a suspected drug premises may apply to authorised officer for a search warrant
- Must have reasonable grounds for believing the premises is being used for the unlawful supply/
manufacture/cultivation of a prohibited drug
- Example: drug affected persons coming and going, syringes, drug paraphernalia, premises
fortified, security devices - CCTV
Question 2: You have been allocated a case for investigation. The information contained in
the case has originated from Polair and relates to a thermal identification for a possible
hydroponic cannabis grow house.
What are your initial enquiries pre warrant leading up to execution?
- Surveillance e.g. take away
- Thermal imaging flyover - aviation unit
- Infra-red thermometer - heat gun
- iASK’s for habitants
- Compare electricity and water bills
- RP data
Question 3: You execute a crime scene warrant. Upon entry you discover an electrical bypass system
and 3 rooms containing 120 cannabis plants with associated grow lights, transformers etc.
and a 4th room with 10kgs of cannabis head on drying racks. In the rear room you find a
family of four - 2 adults and 2 children (2 year old and 4 year old)
What offences are committed?
- Organise drug premises
- Enter/be on/in drug premises
- Possess prohibited plant
- Supply prohibited plant - Large commercial quantity
- Enhanced indoor cultivate/take part in cultivation of a prohibited plant
- Supply prohibited drug - indictable
- Possess prohibited drug - indictable
- Expose child to cultivation of prohibited plant/drug - commercial
- Theft of electricity under the Electricity Supply Act
- Can also put interfere with electrical work under the same Act
Question 4: Name three crime scene powers you would utilise during the execution of the warrant of the drug premises
- Remove persons from crime scene who fail to leave
- Direct a person to leave crime scene
- Prevent persons from removing evidence from crime scene
- Any crime scene powers are correct
