When can a constable require the production of a driving licence from a person?

Sec 42
- They are driving a motor vehicle on the road
- Any driver involved in an RTC in relation to any vehicle on the road
- Suspect a driving offence has occurred on a road
- Any person supervising a prov pic holder, they are supervising a prov liv holder driving/in RTC/committing an offence
Within 5 days with IOM/RT1
Must be produced in person

When delivering an RT1 what should you say/do?

Tell them why you stopped them Discuss/words of advice for offence Ask to see driving licence/insurance Do you have driving licence/insurance? I am going to issue RT1 in relation to failure to produce documents Complete form I am going to report the full facts in relation to you not having d.l and ins and failure to produce d.l. and ins Formal NOW caution PNB name/offence/car deats/time Reply after caution Get them to read and sign PNB

- Suspected to have committed an offence in relation to use of a motor vehicle on a road
Give name and address and owners, and vehicle insurance
MPV commits offence - give name and address
Supervising driver driving/RTC/offence - give name and address

What offence involves failing to stop?
A
Sec 40
Driving a MPV on a road must stop upon being directed by a constable, person riding a cycle also or animal.
Failing to do so constitutes an offence
