Prescribed limit: Alcohol
Breath - 35 micro grams in 100 ml of breath.
Blood - 80 milligrams in 100 ml of blood
Urine - 107 milligrams in 100 ml of urine
Prescribed limits: Drugs
Cocaine:
Blood limit - 10 micro grams per litre
THC (Cannabis):
Blood limit - 2 micro grams per litre
Amphetamine - 250 Diazepam - 550 Ketamine - 20 Methyl-amphetamine - 10 Morphine - 80
Defences to S.5 RTA 1988
Person charged to show:
(a) the specified controlled drug had been prescribed or supplied to him for medical/dental purposes,
(b) he took the drug in accordance with any directions given
(c) his possession of the drug immediately before taking it was not unlawful under S.5 Misuse of Drugs Act 1971
What are the considerations for preliminary breath test?
When did they last consumer alcohol?
At least 20 mins should have passed.
Have they used any ‘breath freshening’ sprays?
Have they smoked recently?
What are the types of preliminary tests?
Preliminary breath test - roadside
Preliminary impairment test - series of physical and psychomotor tests carried out by specially trained officers - roadside or station
Preliminary drug test - sweat or saliva samples - at the scene or a police station
What are the conditions to S.6 RTA 1988?
Requirement can be made if lawfully on private premises.
Officer must be in uniform.
If asked to leave, then no longer lawfully on premises and no power to require will exist.
Any subsequent requirement would be unlawful.
