What are the three requirements of the War Powers Act of 1973?
1) Consultation; 2) reporting; and 3) congressional approval
What does the consultation requirement mean?
The president must consult with Congress before putting US military forces in hostile situations and as long as they remain there.
What does the reporting requirement mean?
The president must report to Congress within 48 hours of introducing military personnel into hostile situations.
What does the congressional approval requirement mean?
unless Congress 1) declares war; 2) authorizes military force; or 3) is unable to meet because of an armed attack, US forces must be removed from hostilities within 60 days of congressional notification.
What does possee comitatus do?
Prohibits the use of military forces for domestic law enforcement.
What branches are allowed to engage in domestic law enforcement under posse comitatus?
Coast Guard and National Guard
May the Army, Air Force, USMC or Navy help law enforcement under posse comitatus?
Yes, just can’t engage in law enforcement.
What did the National Security Act of 1947 do?
Created the DoD, combined the Depts. of the Navy and Army, created the SECDEF, est’d National Security Council, and CIA.
What did the Goldwater Nichols Act of 1986 do?
Reorganized the DoD and created the combatant commanands/commanders.
How many combatant commands are there?
Eleven: seven geographic and four functional.
