Question 1

What are the grounds the court may consider in respect of striking out a statement of case?

Answer 1

1) That the statement of case discloses no reasonable grounds for bringing or defending the claim;
2) That the statement of case is an abuse of process or is otherwise obstructive to just disposal of the proceedings; or,
3) That there has been a failure to comply with a rule, practice direction, or court order.
