Mandatory life sentence
only given for murder but judge is
allowed to state minimum number of
years imposed defendant have to serve
before being eligible for release license

Discretionary life sentence
other serious crimes such as
manslaughter means maximum sentence
is life imprisonment but judge doesn’t
doesn’t have to impose this
Suspended sentence
offender will only go to prison if he
reoffends within a particular time frame
only given if offence is serious that
custodial sentence would be appropriate
but there exceptional circumstances that
justify suspending the sentence
Fixed term sentence
kisses can only give custodial sentence
up to specific length e.g. maximum is 6
months for assault
home detention curfew
offender is ordered to stay home at
certain times up to 16 hours per day
can be monitored by electronic tag
which triggers an alarm if the offender
breaks the curfew
what might offers be given for a non serious crime
non custodial sentence
Section 177 of the Criminal Justice act 2003
adults can be given community order
including one or more of 14 requirements

1.unpaid work (300 hours)
2.work in community
3.curfew requirements (16 hours per day)
4.drug rehabilitation
5.alcohol treatment
6.residence requirements (live in certain
place)
A fine
ordered to pay and compensation is paid to victim
discharge
least severe sentence & can be ABSOLUTE
where no further action will be taken or
conditional where further action will be
taken if offender re-offends
