Delegated bodies definition
Delegated bodies are an authority or agency given power by parliament to make and/or enforce laws. The power to enforce criminal law is given by an Act of Parliament which specifies who has the power to enforce the law.
Victorian delegated bodies:
- Consumer Affairs Victoria
- Environment Protection Authority Victoria (EPA)
- Local councils
- State Revenue Office (SRO)
- VicRoads
- WorkSafe Victoria
What do Consumer Affairs Victoria enforce?
Take action in relation to breaches to consumer trading laws and tendency laws.
What do Environment Protection Authority Victoria enforce?
Power to investigate breaches of environmental laws.
What do Local councils enforce?
Power to enforce local laws.
What do State Revenue Office enforce?
Administers laws relating to taxes, duties and levies.
What do VicRoads enforce?
- Prosecute certain road and traffic offences
- Issue infringement notices for breaches of road rules
What do WorkSafe Victoria enforce?
Monitors and enforces compliance of Victoria’s occupational health and safety laws.
Commonwealth delegated bodies:
- Australian Securities and Investments Commission (ASIC)
- Australian Taxation Office (ATO)
What do Australian Securities and Investments Commission enforce?
- Investigates breaches of legislation
- Matters can be prosecuted by the Commonwealth Director of Public Prosecutions (CDPP)
What do Australian Taxation Office enforce?
- Investigates serious tax-related fraud offences
- Prosecutes summary offences, generally refers serious cases to the CDPP
