Actus Reus
A wrongful deed that comprises the physical components of a crime.
Mens Rea
The state of mind that the prosecution, to secure a conviction, must prove that a defendant had when committing a criminal act.
Eighth Amendment
“Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”
Purposely
A person acts purposely when it is his conscious object to engage in conduct of that nature, and when he is aware of, believes, or hopes that such circumstances exist.
Knowingly
A person acts knowingly when he is aware of his conduct is practically certain that his conduct will cause a certain result.
Recklessly
A substantial and unjustifiable risk that if disregarded would be a gross deviation from the standard of conduct that a law- abiding person would observe in the actor’s situation.
Negligently
A person acts negligently when he should be aware that a substantial and unjustifiable risk will result from his conduct. The risk is of such nature and degree that it involves a gross deviation from the standard of care that a resonable person would observe in the actor’s situation.
Strict Liability
A crime that does not require a mens rea element, such as speeding.
