purpose of bail (2)
- to ensure that the defendant comes to court when required
- to ensure that the defendant appears at every stage of the proceedings

what can bail be set on in the municipal court?
petty disorderly persons and bench warrants
what is bail recognizance?
the contract! (every type of bail has a recognizance even non monetary bail like RORs)
non corporate surety
someone other than the defendant who posts the bail and insures the debt. non corporate meaning not a corporation.

person responsible for the defendant, agrees to the bail conditions and pledges that the defendants obligations will be met.
who is authorized to set bail?

when is bail set?
- bail can be set during the process of issuing a criminal complaint for a petty disorderly persons offense if certain conditions are present (cdr-2) or bail can be set for a failure to appear - bench warrant
10% cash bail
unless the judge specifies no 10% or “FULL” you can take 10% on any municipal court matter.
who can set full cash bail?
ONLY THE JUDGE

Released on own recognizance. is permissible for any offense where the judge/judicial officer deems it appropriate.
