What is the definition of a C/YP in need of care and protection?
They are likely to be sexually, emotionally or physically abused or neglected.
Serious differences between the C/YP and guardian affecting wellbeing.
Guardians are unable or unwilling to control the C/YP.
Child 10-14 is offending to such an extent there is concern for their wellbeing.
What does Section 42 of CYPF Act allow?
Any member of the police who believes on reasonable grounds that it is CRITICALLY NECESSARY to protect a C/YP from injury or death,
May without warrant enter and search a dwelling house, building, aircraft, ship, carriage, vehicle, premises or place and REMOVE or DETAIN the C/YP and place the C/YP in the custody of CYFS.
What does Section 48 of CYPF Act allow?
Where a C/YP is found by police unaccompanied by a parent, guardian or other who usually looks after them.
In a situation in which their Physical or Mental health is being or likely to be, impaired a member of police may
(using reasonable force) take the C/YP with their consent and deliver into the custody of the parent, guardian or other person.
If no consent is given or caregivers are unwilling to take them, place the C/YP in the custody of CYPS.
What does Section 39 of CYPF Act allow?
Allows anyone authorised by warrant to enter and search any dwelling house, building, aircraft, ship, carriage, vehicle, premises or place
if they believe on reasonable grounds that the C/YP has suffered or likely to suffer ill treatment serious neglect abuse, serious deprivation or serious harm to remove or detain the C/YP (using force if necessary) and place them in the custody of CYPS.
