Sexual Assault
Intentional sexual CONTACT characterized by use of force, threats, intimidation, or abuse of authority or when the victim does not or cannot CONSENT.
Consent
A freely given agreement to the conduct at issue by a competent person
Unrestricted report
Any report of sexual assault received through normal reporting channels including the victim’s chain of command, law enforcement, and the OSI or other criminal investigative service
Restricted report
a confidential report of sexual assault that removes barriers to medical care and support while giving the victim additional time and increased control over the release and management of personal information
What will always trigger an unrestricted report
Any report of sexual assault made to a mandatory reporter, whether directly from the victim or a third party
People able to keep confidentiality
- Chaplain
- Medical Professionals
- SARC
- SVC
*Chaplain is the only one who can keep full confidentiality in all circumstances
Who is considered a mandatory reporter
- Chain of command
- LEO, OSI, SFS
Situations that are mandatory to report
Child abuse
homicidal
suicidal
domestic abuse
Sexual Harassment
A form of discrimination that involves unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when:
Commander & supervisors responsibility
◾Review all complaints thoroughly, and consider each one individually
◾Initiate a formal investigation if warranted
◾Take swift action if the complaint is found to be valid
◾If complaints ignored or not addressed the commander/supervisor is condoning the sexual harassment and may have actions come against them.
◾Ensure reprisals of a direct or indirect nature do not take place with the complainant.
Commander responsibilities regarding sexual harassment
◾MUST take swift, firm corrective or disciplinary action against the offender.
◾MUST ensure no retaliatory action is taken against the complainant.
Physical Sexual Harassment
Physical sexual harassment may include patting, pinching, hugging, grabbing, rubbing, massaging, deliberate touching, or any other unnecessary physical contact. Blocking a person’s path, or pinning a person against a wall can also constitute sexual harassment.
Nonverbal Sexual Harassment
Nonverbal sexual harassment may include sexually demeaning notes or cartoons, nude pictures in and around the work area, or ashtrays, coffee mugs, or figurines of a sexual nature.
Verbal Sexual Harassment
Verbal sexual harassment may include inquiries into a person’s intimate or personal relationships, sexually oriented comments about one’s appearance, or continued pressure for dates, particularly after refusals.

Sexual harassment, real or perceived, degrades leadership and interferes with command authority and mission effectiveness
