custodial sentencing Flashcards
strength vera institute of justice
Shirley
Vera institute of justice claims that offenders who take pert in college education programmes are 43% less likely to reoffend following release, and that prisons who offer these programmes report fewer incidents of violence. This is a strength of the aim of rehabilitation, reduces recidivism. However, too ‘soft’ and more like a holiday camp that wont deter offenders.
strength
Gillis and Nafekh
Gillis and Nafekh researched the relationship between employment status and community outcomes for two groups of offenders, namely those employed while on conditional release and matched comparison group of offenders who were unemployed- employed men and women were more likely to remain on conditional release until the end of their sentence and less likely to return to prison. again providing strengths of the aim of rehabilitation preventing the cycle of being in and out of prison due to not being able to find jobs ect. Reduces recidivism.
weakness ministry of justice
According to the Ministry of justice a record 119 people killed themselves in prison in England and Wales in 2016 a 32% increase of the precious year- an average suicide of 1 every 3 days- almost 9x higher than the general population. Most at risk are young single men during the first 24 hours of containment.
weakness psychosis prison reform trust
Prison reform trust found that 25% of women and 15% of men in prison reported symptoms of psychosis so oppressive prison regimes may be detrimental to psychological health which could impact on rehabilitation.
HOWEVER, there is a problem with cause and effect as we do not know if this is a problem with the prison regime or something else like the trauma of being locked away regardless of what the prison is like.
