(objective - was it reasonable considering what they knew at the time)

2) Which prevented forming the MR of the crime

  • voluntary: specific intent crimes only (so intention)
  • involuntary: specific and basic intent crimes

If no MR, defendant is acquitted

Loss of control (partial defence)
1) Loss of control - can result from gradual provocation 2) Resulted from qualifying trigger - e.g. fear of serious violence or grave circumstances to fear - sexual infidelity doesn't count. 3) Person of D's sex and age with normal degree of tolerance and self-restraint might have reacted in a similar way in same circumstances

1) Abnormality of mental function 2) Caused by recognised medical condition 3) Condition substantially impaired D's ability to understand nature of conduct / form rational judgement / exercise self control 3) Condition provides explanation for D's acts or omissions
