The person who actually commits the crime
Perpetrator
A criminal offence that involves helping a perpetrator commit a crime
Aiding
The crime of encouraging the perpetrator to commit an offence
Abetting
A crime that involves advising, recommending, or persuading another person to commit a criminal offence
Counselling
A deliberate intention to commit a wrongful act, with reckless disregard for the consequences
Mens rea
“The guilty Act”. The voluntary action, omission, or state of being that is forbidden by the Criminal Code
Actus reus
Laws covering less serious offences at the provincial or municipal level, most often punishable by fines
quasi-criminal law
The desire to commit one wrongful act for the sake of accomplishing another
Specific intent
The reason a person commits a crime
Motive
An offence that the Crown can decide to try as summary or indictable
Hybrid offence
A criminal offence that involves selling, giving, transporting, or distributing a controlled substance or an authorization for a controlled substance
Trafficking
A serious offence
Indictable
A less serious crime
Summary conviction
A common bawdy, betting, or gambling house; a brothel
Disorderly house
A killing for which the accused can be held legally responsible
Culpable homicide
Having knowledge and control over something
Possession
Planning with 2 or more people to commit an unlawful act, even if the crime is never committed
Conspiracy
A deliberate closing of one’s mind to the consequences
Wilful blindness
Taking property, either temporarily or permanently, without the owners permission
Theft
Theft with violence or a threat of violence
Robbery
Breaking into a place without permission with the intent to commit an indictable offence
Breaking and Entering
The killing of another person, directly or indirectly
Homicide
The desire to commit an unlawful act with no purpose or reason
General Intent
Damage to property
Mischief
Falsely reporting crimes and wasting police resources
Public mischief
The mens rea does not have to be proven, they took precaution
Strict liability offence
The accused gets no defence
Absolute liability offence
