Either way or indictable offences
Cannot be summary offences

What is the definition of Criminal Attempts?
if with intent to commit an offence triable on indictment a person does an act more than merely prepatory to committing the offence, they are guilty of attempting to commit the offence
What is the penalty for a Criminal Attempt?
liable to the penalty of the full offence
Can a person ‘attempt’ the impossible?
A person may be guilty of attempting to commit an offence even though the facts are such that the commission of the offence is impossible
e.g. smuggling talcom powder thinking that it is drugs
