Carjacking
C felony/ General sessions
- Take or attempt to take a persons vehicle by force
- No more than 20 years up to 30 years
Burglary 1st
Felony/ General sessions
- Entering a dwelling without consent or with intent to commit a crime
- Is armed, causes physical harm, uses threats, has prior record of 2 or more burglary’s or exits during nighttime
- Life in prison no less than 15 years
Burglary 2nd
Felony / General sessions
- Entering a dwelling without consent, with intent to commit a crime (no aggressive factors present) or in a building with factors
- Same as 1st
- A: no more than 10 years
- B: no more than 15 years/ no parole
Burglary 3rd
Felony/ General sessions
- Enters a dwelling and intends to commit a crime
- First offense 5 years
- Second offense 10 years
Common law robbery
A Felony/ General sessions
- Larceny from the person or the immediate presence thereof, use of intimidation
- Max 15 years in prison
Strong arm robbery
A Felony/ General sessions
- Larceny from the person or presence thereof, use of force
- Max 15 years in prison
Armed robbery
A felony/ General sessions
- Larceny from the person or presence thereof, Use of a deadly weapon
- Max 30 years min 10 years in prison
Trespass: another’s pasture or land after notice
Exempt Misdemeanor/ Summary
- The accused entered the property of another in which they are on notice from.
- Fined $100 or imprisoned for 30 days
Trespass: Another’s land for various purpose without permission
Exempt Misdemeanor/ 1st/2nd Summary/ 3rd General sessions
- Entry with the purpose of hunting, fishing, trapping, ect.
- 1st offense: $200 or 30 days
- 2nd offense: $100-$200 30 days
- 3rd offense:$500-$1,000 or 6 months or both
Entering premises after warning or refusing to leave on request
Exempt misdemeanor/ Summary
-The accused entered the dwelling or place of business without permission, accused had been warned not to enter
Grand larceny
Felony/ General sessions
- Unlawful taking and carrying away of the persons property with the intent to deprive the owner pf the property.
- Value more than $2,000 but less than $10,000
Petty larceny
Exempt misdemeanor/ Summary
- Unlawful taking of a persons property with intent to deprive them of that property
- Value less than $2,000
Shoplifting
Exempt misdemeanor or felony/ Summary court($2,000 or less) General sessions (more than $2,000)
- To transfer from one person to another or from an area in a store with the intent of not paying for items
- Removal or transfer of any tags or labels to deprive the merchant of the items full retail value
Receiving stolen goods
class A/Exempt misdemeanor or felony/
Summary: if value is less than $2,000
General sessions: Value is more than $2,000
-Bought, received or possessed stolen goods or property knowing it was stolen
Embezzlement of public funds
Felony/ General sessions
-While a public employee charged with converting funds for his or her own use
(if convicted, accused id disqualified from public position unless is removed by 2/3 vote of general assembly and full payment plus interest of embezzled money is paid off)
