What 3 criteria fall into CPP
Sexual abuse, physical abuse, neglect
Explain sexual and physical abuse
Sexual abuse is an act involving indecency with, or violation of a child, or using a child in the making of sexual imaging.
Physical abuse is when the actions of the offender result in, or could result in, physical harm or injury to the child. Also called non accidental injury
Three areas to consider if physical abuse meets the threshold for CPP
The action (of the abuse) The injury inflicted (outcome or result) The circumstances (factors in the case)
Explain neglect
Intentionally ill treats a child or causes or permits the child to be ill treated, in manner likely to cause actual bodily harm, injury or health or mental disorder or disability.
Eg,
No food, shelter or clothing
Not protecting from physical harm or danger
Not accessing appropriate medical treatment
3 initial steps OT and Police must follow
Referral - information sharing between both agencies
Consultation - discussion at appropriate levels
Agreement - agreeing upon an initial action in an Initial Joint Investigation Plan
Topics to be considered in IJIP
Immediate safety of children
If a joint visit is required
Management of the initial interview
Referral to Medical practitioner and authority to do so
Collection of physical evidence
Any further action agreed for Police and OT
Can you question a child
If child has made clear disclosure to an adult, and the adult can give you the info, do not ask them again what has happened to them
If it is unclear what child has said and no urgent safety issues do not question further
If absolutely necessary, ask open ended questions
Do not continue to question the child if it becomes clear while speaking to them that an offence has occurred
Orange Tamariki timeframes
Critical - 24 hours, child at risk of serious harm, and requires immediate involvement to establish safety
Very urgent - 48 hours, at risk of serious harm but has some protective factors present for the next 48 hours. High priority follow up is required
Urgent - 7 days, at risk of harm or neglect and the circumstances are likely to negatively impact on the child. Options of safety and support have been explored but remain unmet. Patterns that limit protective factors
