lemon sour cuz taxes going towards reglious private schools

Lemon won, now we have the Lemon test
Bethel v. Fraser
Fraser funny suggestive speech —> suspended

Fraser lost :(, schools can now limit speech that is lewd/vulgar
Morse v. Frederick
“bong hits 4 jesus!” one
Frederick lost and the school (pricipal Morse) won 5-4
1st amendment: freedom of speech
schools can now limit student expression/speech in relation to illegal drugs
Hazelwood BOE v. Kuhlmeier
teen pregnancy & divorce topic in the student paper –> got taken down
1st amendment: freedom of press
public schools can censor student press if they have a legit reason
Gregg v. GA
Gregg murdered a bunch of people as a hitchhiker & got the death penalty
8th amendment: cruel & unsual punishments
The Death Penalty is constitutional and legal, as long as it’s used appropriately for the right crimes and after proper investigation
Gideon v. Wainwright
Gideon gets a lawyerrrrrrrrrr
6th amendment: right to counsel
Unanimously won (9-0)
All defendants will get a lawyer no matter the case & whether or not they can afford it
NJ v. TLO
TLO got her purse searched w/out a warrant in the school bathroom
4th amendment: need a warrant to search
TLO lost, schools can do warrantless searches with probable cause
Mapp v. Ohio
Dolly Mapp - fake warrant one
4th amendment: exclusionary rule
Mapp won, the exclusionary rule extends for ALL cases no matter the caliber of the investigation
In re Gault
we know this one, Gault lost 5-4, due process was indeed followed
5th amendment: Due Process
Due Process applies to minors just as much as it does to adults
Roper v. Simmons
Simmons murdered at the age of 17
8th amendment: excessive/cruel/unusual punishment
Simmons won 5-4, no Death Penalty for all minors
Thompson v. Oklahoma
William Wayne killed Charles as a 15 yr old
8th amendment: excessive/cruel/unusual punishment
Wayne won, no death penalty for 15 year olds (anyone under 16)
D.O.C v. Heller
Dick Anthony Heller - gun dude
Heller won with 5-4
2nd Amendment: right to bear arms (“militia” part specifically)
Right to bear arms extends to individuals for personal (legal still) use
Miranda v. Arizona
Ernesto Miranda didn’t know his rights & confessed to everything
5th Amendment: self incrimination
Miranda won 5-4: now we have Miranda rights that must be read aloud
