Copyright, Design, and Patents Act 1988 protects any original literary, dramatic, musical, or artistic work that required skill, labour, and judgement in its creation from after August 1st 1989
Photos taken before August 1st 1989 relevant act
Copyright then falls under the Copyright Act 1956 which gives first ownership to the commissioner and not the creator.
Photos taken at private and Domestic Events
Photographs commissioned for private or domestic events also need the commissioner’s permission as a moral right to ownership.
Fair Dealing Defence
Section 30 of the CDPA 1988 allows publication of work protected by copyright if for the purpose of reporting current events, and that significant acknowledgement is given. Fair Dealing does not cover still images.
