How would you recognise cannabis?

A

Dried, rough grass. Often has seeds, twigs and stems. Greyish green, greenish brown, reddish brown. Has a distinctive sweet smell.

A

That the person was in possession of the controlled drug; I.e. able to exercise some form of control over it

What are you required to prove if you charge a person with possession of instruments under MODA 1975?

A

That the utensil wasnim fact capable of use I.e. not broken or ornamental, and that the suspect was currently using it or intending to do so in the future

What is the presumption of possession for supply?

A

Amounts of drugs regarded as an indication:

  • 0.5g of cocaine or heroine
  • 5g of morphine or methamphetamine
  • 100 cannabis cigarettes
  • 28g of cannabis
  • 56g of other controlled drug

It is an indication only, to assist prosecution. Generally additional evidence is required
