2 houses of Congress and their differences
House of Representatives: stated would have representation based on their population.
Senate: states would have equal representation
Requirements for House, senators, and the president
House: be at least 25, U.S. Citizen for 7 years and live in the state you represent.
Senators: U.S. citizen for 9 years and at least 30 years old.
President: U.S. born citizen a resident for 14 years and 35 years old at least.
Number of terms for House, Senators, President, and federal judges including the Supreme Court justices.
House: two year terms Senators: 6 year terms President: 4 year terms Federal judges: have different terms in office Supreme Court justices: serve for life
5 of the enumerated or delegated powers granted to Congress
1) Congress shall have power.
2) to borrow money on the credit of the U.S.
3) to establish post offices and post routes.
4) to provide and maintain a navy
5) to constitute tribunals interior to the Supreme Court
Powers of the president
1) approves or veto laws
2) conducts U.S. foreign relations and makes treaties with foreign governments
3) nominates cabinet members ambassadors and federal judges
4) serves as commander-in-chief of the U.S. armed forces
5) prepares the federal government budget
Powers of the Supreme Court
The Supreme Court has original jurisdiction the power to hear cases for the first time not on appeal from a lower court.
The power of the court claimed for itself in the case of Marbury versus Madison
The court overturned an act of Congress the Chief Justice ruled that Congress in passing the law had acted outside the bounds of its constitutional power. It started a debate whether the court should take an active role in making policy by overturning laws or should the court restraint.
Process to remove the president
Only the House of Representatives can vote to impeach however only in the Senate can convict. If the Senate votes by a two thirds majority to convict the official is removed from office.
Difference between articles of the Constitution and amendments
Articles were written by our four founding fathers and amendments are the changes made over the years.
First amendment
Five rights.
Second amendment
Right to bear arms
Fourth amendment
Rights and protections for people who are accused of crimes.
Fifth amendment
The fourth amendment but with more detail.
13th amendment
Abolish slavery
14th amendment
Equal protection under laws.
